1.Scope
This Acceptable Use Policy ("AUP") governs what you may do with the WhatFlare platform. It is incorporated into our Terms of Service, and breaching it is a material breach of those Terms.
This AUP applies in addition to — never instead of — Meta's rules. You must independently comply with the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's Community Standards. Where this AUP and Meta's policies differ, the stricter rule applies.
WhatsApp enforcement is largely automated and driven by recipient behaviour. Blocks and "report" taps lower your quality rating, which lowers your messaging limits, and repeated violations get numbers restricted or banned. Following this policy is not bureaucracy — it is how you keep your number alive and your throughput high.
2.Opt-in is mandatory
You must obtain and be able to evidence opt-in from every recipient before messaging them. This is the single most important rule on this page.
2.1 What valid opt-in requires
- The person actively agreed to receive messages from you on WhatsApp — a pre-ticked box or silence is not consent.
- Your business name was clearly stated at the point of opt-in, so the person knows who will message them.
- The type of messages was made clear (order updates, marketing offers, appointment reminders, and so on).
- Opt-in was collected on a channel the person chose — your website, app, a form, in-store, a chat, or an existing WhatsApp conversation they started.
- You keep a record of when, where and how consent was given, and can produce it on request.
2.2 What is never valid opt-in
- Purchased, rented, scraped or otherwise third-party-sourced contact lists
- Numbers harvested from public directories, social media or websites
- Consent given to a different business, or transferred with an acquired list without fresh consent
- Consent for a different channel — an email subscriber has not opted in to WhatsApp
- Assumed consent because someone is an existing customer
3.Honouring opt-out
- Provide a clear, easy way to stop receiving messages, and state it in your marketing messages.
- Honour opt-out requests promptly — including free-text requests such as "stop", "unsubscribe" or "don't message me", not only a button tap.
- Once a person opts out, do not message them again unless they re-initiate contact or give fresh consent.
- Treat a block or a report as an opt-out.
- Do not attempt to reach an opted-out person from a different number to circumvent their choice.
4.Prohibited content
You may not use the Services to send, store, promote or facilitate:
- Illegal content — anything unlawful in the sender's or recipient's jurisdiction
- Child sexual abuse material — reported to authorities without exception and with immediate permanent termination
- Violence and terrorism — threats, incitement, or content supporting violent or terrorist organisations
- Hate speech — attacks on people based on race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability or serious disease
- Harassment — bullying, stalking, doxxing or targeted abuse
- Fraud and deception — phishing, scams, fake offers, impersonation of any person or organisation, or spoofed sender identity
- Malware — viruses, ransomware, or links to malicious sites
- Adult content — sexually explicit material or services
- Misinformation — content likely to cause real-world harm, including medical and electoral misinformation
- Intellectual property infringement — content you do not have rights to
- Sensitive personal data — sending health, financial, biometric or government-ID data without a lawful basis and appropriate safeguards
5.Restricted and prohibited industries
Meta's Commerce Policy prohibits or restricts certain categories. You may not use the Services to promote or sell:
- Illegal, prescription or recreational drugs, and drug paraphernalia
- Tobacco, vaping and related products
- Alcohol, where restricted in the destination market
- Weapons, ammunition and explosives
- Live animals and endangered species products
- Adult products and services
- Gambling, betting and real-money gaming, except with prior written approval from us and where lawful in the destination market
- Cryptocurrency and speculative financial products, except with prior written approval and applicable licensing
- Multi-level marketing, pyramid schemes and get-rich-quick offers
- Counterfeit goods
- Unlicensed medical, legal or financial services
If you operate in a regulated sector, you must hold the licences your jurisdiction requires and provide evidence on request.
6.Messaging conduct
- Identify yourself in every conversation. Recipients must know which business is messaging them.
- Be relevant. Send what the person opted in to receive, at a reasonable frequency.
- Respect timing. Avoid messaging outside reasonable local hours in the recipient's timezone.
- Do not spam. No bulk unsolicited messaging, no repeated messaging of non-responders, no message bombing.
- Use templates honestly. Do not submit a template in one category to obtain a cheaper rate and then use it for another purpose — notably, do not send marketing content through utility or authentication templates.
- Do not misuse the service window. Do not provoke a reply purely to open a cheaper 24-hour window for marketing.
- Do not rotate numbers to evade rate limits, quality ratings or bans.
7.Platform conduct
- No attempts to breach, probe or circumvent security controls or rate limits
- No scraping, crawling or bulk extraction of platform data
- No reverse engineering, decompiling or deriving source code
- No sharing of account credentials, and no reselling access without written agreement
- No use of the Services to build a competing product
- No load that degrades service for other customers
- No use of unofficial, unauthorised or reverse-engineered WhatsApp clients or libraries in connection with the Services
8.AI features and automation
- Do not present an AI agent as a human when a recipient directly asks whether they are speaking to a person.
- Provide a reasonable path to a human for support conversations.
- You are responsible for what your AI agent says. Review your knowledge base and instructions, and do not deploy an agent to give regulated medical, legal or financial advice without appropriate qualification and disclaimers.
- Do not use AI features to generate content prohibited under section 4.
9.Quality rating and messaging limits
Meta assigns each number a quality rating based on recipient feedback — blocks, reports and engagement. Ratings and messaging limits are set by Meta, not by us.
If your rating drops, we may contact you, require corrective action, or temporarily restrict sending volume to protect your number and the platform. Repeated low ratings may lead to suspension under section 10.
10.Enforcement
Where we believe this AUP has been breached, we may — proportionately to the severity:
- Contact you and require corrective action
- Restrict sending volume or specific features
- Remove offending content or templates
- Suspend the account, in whole or in part
- Terminate the account under the Terms of Service
- Report to law enforcement, where we are required to or where there is a risk of serious harm
We will give notice and an opportunity to fix the problem where circumstances reasonably permit. For severe violations — child safety, terrorism, coordinated fraud — we act immediately and without notice.
Suspension or termination for a breach of this AUP does not entitle you to a refund of prepaid fees or wallet balance.
11.Reporting abuse
If you receive an unwanted or abusive message sent through our platform, or you believe a customer is violating this policy, tell us and we will investigate.
